Senseware director vows to fight Dell writ

Kent reseller Senseware has vowed to defend itself against the writ filed by Dell in which it is claiming damages of more than $1.8m.

As exclusively revealed in PC Dealer, the writ was filed against Senseware, its director Mark Daniel, and two other individuals, Liam Keehan and Fred Power of Ireland. The writ claimed for damages of $1,855,840, a declaration and an account of profit relating to alleged theft and sale of the computer kit.

But Daniel has since contacted PC Dealer via solicitors Thomas Dunton to respond to the allegations. The statement claimed one of the defendants had been prosecuted, but was found not guilty.

The statement added: "We understand the claim relates to a period approximately six years ago, when it is alleged that Dell suffered various losses of stock from its premises. It is not alleged that any theft was made either by Mark Daniel or The Senseware Company, merely that some of these items purchased in good faith by Mark Daniel and/or The Senseware Company may have been sold in the normal course of business."

The statement claimed Daniel had been surprised that Dell had decided to pursue the case as he had heard nothing from the vendor for five-and-a-half years. It added that if the writ was served, Daniel would defend the case.

The writ was issued by solicitors Geoffrey Leaver, on behalf of Dell and its insurers, National Union Fire Insurance Company.

Dell and National Union refused to comment.
